Agreement & Scope
By accessing or using PodThis, you agree to be bound by these Terms of Service (including the Acceptable Use provisions herein) and our Privacy Policy. If you disagree with any part of these terms, you may not access the service.
These terms incorporate our acceptable use requirements, which were previously published as a separate policy. All acceptable use obligations are now part of this single agreement.

Your Responsibilities
Content Ownership
You retain full ownership of content you provide and podcasts you generate.

Lawful Use
Use the service only for lawful purposes that respect others.
Content Quality
Ensure your content is accurate and respects intellectual property.
Acceptable Use
Permitted Uses
PodThis is designed for the following legitimate purposes:
Podcast Creation
Generating original podcast episodes from your ideas, topics, and source materials.
Educational Content
Creating informative podcasts for learning, training, tutorials, and knowledge sharing.
Entertainment
Producing creative storytelling, commentary, reviews, and entertainment programming.
Business Communications
Internal communications, corporate updates, marketing content, and thought leadership.
Prohibited Content
The following types of content are strictly forbidden. Violations may result in immediate account termination:
- Hate Speech: Content promoting violence or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
- Harassment: Content that threatens, bullies, stalks, or intimidates individuals or groups, including doxxing and targeted abuse campaigns.
- Illegal Content: Content that promotes or facilitates illegal activities including fraud, drug trafficking, weapons sales, or money laundering.
- Child Safety: Any content that exploits or endangers minors. We report violations to NCMEC and relevant authorities. Zero tolerance.
- Terrorism: Content that promotes, recruits for, or provides material support to terrorist organizations or violent extremism.
- Dangerous Misinformation: Deliberately false content about public health, elections, or emergencies that could cause real-world harm.
AI-Specific Restrictions
Additional rules that apply specifically to the use of AI-generated content:
- No Deepfakes: Do not use AI voices to impersonate real people without their explicit, documented consent.
- No Deceptive Content: Do not present AI-generated content as human-created with intent to deceive your audience.
- No Jailbreaking: Do not attempt to bypass AI safety filters, content moderation, or system prompts.
- No Competing Models: Do not use PodThis outputs to train, fine-tune, or develop competing AI models or services.
- No False Attribution: Do not attribute AI-generated content to specific human authors, experts, or institutions without authorization.
- No Automated Abuse: Do not use bots, scripts, or automated tools to mass-generate content or circumvent usage limits.
Content Labeling & Transparency
Transparency builds trust. We require the following labeling practices:
- EU AI Act Compliance: PodThis embeds metadata in generated audio to identify it as AI-produced, in accordance with EU AI Act transparency obligations.
- Audio Labels: You must not remove, alter, or obscure AI-generated content labels, watermarks, or metadata embedded by PodThis.
- Audience Trust: When distributing content, we encourage clear disclosure to your audience that the podcast was generated with AI assistance.
- Distribution Rules: When publishing on third-party platforms, you must comply with their AI content disclosure requirements in addition to ours.
Subscription & Billing
Billing
Monthly or annual billing, always in advance.
Cancellation
Cancel anytime. Service continues until period ends.
Refunds
Pro-rated refunds within 14 days of upgrade.
Price Changes
30 days advance notice for any pricing updates.
AI-Generated Content
- Content Ownership: You retain ownership of the content you provide as input. We assign to you all rights in the AI-generated outputs, to the extent such rights are assignable under applicable law.
- Copyright Notice: AI-generated content may not qualify for copyright protection in all jurisdictions. We make no guarantees regarding the copyrightability of AI-generated outputs.
- No AI Training: Your content is not used to train or improve AI models. It is sent to Google Gemini API solely for processing your podcast generation requests.
- Accuracy Disclaimer: AI-generated content is provided "as-is" and may contain errors, inaccuracies, or hallucinations. You are responsible for reviewing all content before publishing.
- Non-Uniqueness: Similar inputs may produce similar outputs across different users. AI outputs are not guaranteed to be unique.
- Content Labeling: PodThis may include metadata in generated audio indicating it was AI-generated, in compliance with applicable regulations including the EU AI Act.
Enforcement & Termination
Graduated Enforcement
The severity of our response depends on the nature and frequency of the violation:
Warning
For first-time or minor violations, we issue a written warning with guidance on corrective action.
Content Removal
For repeated or moderate violations, offending content will be removed and your account may be temporarily restricted.
Suspension / Ban
For severe or ongoing violations, your account will be suspended or permanently terminated. Serious violations result in immediate ban.
Appeals
If you believe an enforcement action was taken in error, you may submit an appeal to legal@podthis.com within 14 days. Appeals will be reviewed by a team member who was not involved in the original decision. We aim to respond within 10 business days. During the appeal process, any restrictions will remain in effect unless otherwise communicated.
Termination
By You
Cancel your account at any time. Your data will be deleted within 30 days, except where retention is required by law.
By Us
We may suspend or terminate your account for violation of these terms, with notice where reasonably possible.
Data Export
Before termination takes effect, you may export your content. We provide a 30-day grace period for voluntary closures.
Refunds on Termination
If we terminate your account without cause, we will provide a pro-rated refund. No refund for termination due to violations.
Legal Protections
License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use PodThis for your podcast creation needs in accordance with these terms. You grant us a limited license to process your content solely for the purpose of providing and improving the service.
Disclaimer of Warranties
PodThis is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for any particular purpose.
Limitation of Liability
- PodThis shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses.
- Our total liability shall not exceed the greater of (a) the amount you paid us in the 12 months prior to the claim, or (b) EUR 100.
- We are not liable for any decisions or actions you take based on AI-generated content. You are responsible for verifying accuracy before use.
Indemnification
You agree to indemnify, defend, and hold harmless PodThis and its founders, employees, and affiliates from claims arising from:
- Your use of the service or any content you generate, publish, or distribute.
- Your violation of these terms (including the acceptable use provisions) or any applicable law.
- Your infringement of any third-party rights, including intellectual property rights.
Disputes & Governing Law
- Informal Resolution: Before filing a formal dispute, you agree to contact us at legal@podthis.com and attempt to resolve the matter informally within 30 days.
- Governing Law: These terms are governed by the laws of Sweden, without regard to conflict of law provisions.
- Jurisdiction: Any disputes not resolved informally shall be submitted to the exclusive jurisdiction of the courts of Gothenburg, Sweden.
- EU Consumers: If you are an EU consumer, you retain the right to bring proceedings in your country of residence. Nothing in these terms limits your statutory consumer rights.
- Force Majeure: Neither party shall be liable for any failure or delay in performance due to circumstances beyond reasonable control, including natural disasters, war, terrorism, pandemics, government actions, power failures, internet disruptions, or failures of third-party services (including AI providers).
Changes & Contact
Changes to These Terms
We may update these terms from time to time. For material changes, we will provide at least 30 days' notice via email or in-app notification before changes take effect. Your continued use of PodThis after the effective date constitutes acceptance of the updated terms. If you do not agree, you may close your account before the changes take effect.
