Overview
PodThis respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using the PodThis platform.
If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via our service, please notify our designated copyright agent as described below. For your complaint to be valid under the DMCA, you must provide the information outlined in the following section.
Filing a DMCA Takedown Notice
To file a valid DMCA takedown notice, you must provide the following information in writing:
Identify the Work
Identification of the copyrighted work you claim has been infringed, including registration number if available
Locate the Material
Identification of the infringing material and its location on PodThis, with enough detail for us to find it
Contact Information
Your name, address, telephone number, and email address so we can reach you
Good Faith Statement
A statement that you have a good faith belief that the use is not authorized by the copyright owner
Accuracy Under Penalty
A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
Signature
A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
Counter-Notification
If you believe your content was removed in error or is not infringing, you may file a counter-notification with our designated agent. Your counter-notification must include:
- • Your physical or electronic signature
- • Identification of the material that was removed and its location before removal
- • A statement under penalty of perjury that you have a good faith belief that the material was removed by mistake or misidentification
- • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10-14 business days, we will restore the removed content.

🚫 Repeat Infringers
We have a strict policy regarding repeat copyright infringement:
First Offense
Content is removed and a warning is issued to the account holder
Second Offense
Content is removed and the account is temporarily suspended
Third Offense
Account is permanently terminated in accordance with the DMCA
PodThis reserves the right to terminate the accounts of users who are determined to be repeat infringers at our sole discretion. We may also terminate accounts after a single instance of particularly egregious infringement.
AI-Generated Content Notice

Inadvertent References
AI-generated podcast content may inadvertently reference, paraphrase, or resemble copyrighted material from its training data
User Responsibility
Users are responsible for reviewing all AI-generated content before publishing to ensure it does not infringe on any copyrights
Review Before Publishing
We strongly recommend reviewing all generated scripts, show notes, and content for potential copyright issues prior to distribution
Content Safeguards
PodThis employs content moderation systems to minimize the risk of generating infringing material, but no system is perfect
Safe Harbor
PodThis qualifies for safe harbor protection under Section 512 of the Digital Millennium Copyright Act. As a service provider, PodThis hosts and transmits user-generated content but does not control the specific content uploaded or generated by its users.
We have implemented the following measures to maintain our safe harbor status:
- • Designated a copyright agent to receive DMCA notifications
- • Implemented a repeat infringer policy that provides for termination of accounts
- • Adopted and reasonably implemented a policy of accommodating standard technical measures used by copyright owners to identify or protect copyrighted works
- • Expeditiously removing or disabling access to infringing material upon receiving valid DMCA takedown notices
